On August 10, 2008, [redacted] and his acquaintance, [redacted] were standing at the south corner of the intersection of [redacted] and [redacted] in Brooklyn. PO Martin Haber, Sgt. Vandyke, PO Peter Rubin and PO Brian Tiernan, all of the 83rd Precinct approached them (Allegation A) and PO Haber allegedly placed [redacted] a full-nelson (Allegation B). [redacted] was stopped and an unidentified officer took his identification from his pocket (Allegations C and D). One of PO Haber's partners, though [redacted] did not see which, allegedly searched him by removing his wallet, and several frisked him (Allegation E).
