At about 6:45PM on September 9, 2008, at [redacted] in Manhattan, [redacted] and a female (identified through investigation as [redacted] were standing in the lobby when PO Marcelino Alvarez, PO Ramiro Ruiz, and PO Keno Chambers of the 23rd Precinct entered into the building. PO Alvarez and PO Ruiz ran after [redacted] as they were making their way upstairs while PO Chambers watched over [redacted] and the female. PO Ruiz and PO Alvarez caught up with [redacted] on the third floor and placed them in handcuffs. PO Ruiz and PO Alvarez took [redacted] down to the lobby. An officer searched [redacted]s bag (Allegation A). PO Alvarez asked the defendants what they were doing in the building and [redacted] replied that he was visiting [redacted] PO Alvarez told [redacted] that he did not know what the "fuck" he was talking about (Allegation B). PO Alvarez punched [redacted] on the left cheek while PO Ruiz hits [redacted] on the back of the head (Allegations C and D). PO Alvarez and PO Ruiz pushed [redacted] from one wall to the other (Allegations E and F). As a result, [redacted] hit his right knee on a radiator that is in the lobby and fell to his knees and flat on his face. PO Alvarez picked [redacted] up from the floor and punched him on his stomach (also Allegation C). When [redacted] told PO Alvarez and PO Ruiz to stop hitting [redacted] PO Alvarez asked him if he "wanted some" (Allegation G).
