On October 19, 2008 at approximately 8:30 PM, [redacted] was driving on South Avenue in Staten Island with three friends; [redacted] and [redacted] PO Improta opened the car door and called [redacted] an "asshole" (Allegation A). [redacted] asked PO Improta for his name and badge, which PO Improta refused to provide (Allegation B). PO Improta said, "Don't worry about it. Don't be an asshole, " and "Since you want to be an asshole, get out of the car. You are being arrested for disorderly conduct" (Allegation A). [redacted] exited the car and was placed into handcuffs. During the handcuffing, he inadvertently hurt his ankle and subsequently was unable to walk. [redacted] fell to the ground due to his ankle injury. Other officers began to arrive on scene at this time. As [redacted] was unable to walk, PO Improta and officers began to drag [redacted] around South Avenue (Allegations C and D). An ambulance responded to the area. As PO Improta and officers dragged [redacted] around the immediate area, [redacted] heard the officers state to the effect of, "You want to be a wise guy, asshole?" (Allegation E ) [redacted] then told the officers that he wanted to get into the ambulance, but the officers told him that he was going into the van. Officers then picked up [redacted] and threw him into the police van, threw him out of the police van and into the side of a stretcher where he landed in the street (Allegation D). [redacted] was then searched by an officer within his underwear, in between the clefts of his buttocks, coming in contact with but not penetrating his rectum (Allegation F). Read report for details.
