Summary

On December 4, 2008, while driving his vehicle (determined through DMV to be a tan Hyundai) with three other occupants [redacted] and [redacted] (unknown last name), was stopped by two officers he identified as Officer Victor Charles and Officer Fermin Pichardo at the intersection of East 120th Street and 3rd Avenue, in Manhattan (allegations A and B). During the stop, two additional officers, one of who [redacted] identified as Officer Christopher Contreras and the other identified through investigation as Sgt. Howard Zweben, joined the initial two officers. The occupants of the vehicle were each instructed to exit the vehicle one after the other and they were frisked and allegedly searched by the officers (allegations C and D). [redacted] questioned the officers' reason(s) for stopping his vehicle and he was informed that there was a report of an assault with a knife involving three or four Hispanic males in a silver vehicle. After they were frisked, Officer Charles, Officer Pichardo and Officer Contreras allegedly spoke discourteously towards [redacted] and [redacted] by making statements to the effect of "this guy gets pussy"" (allegations E, F, and G).
