On March 3, 2009, at approximately 7:45 pm, [redacted] and [redacted] were riding in [redacted]'s vehicle when they were pulled over by a marked police van [redacted] in the Bronx. As PO Rafael Perdomo of the 46th Precinct recovered [redacted]'s identification and vehicle registration information, [redacted]'s neighbor, [redacted], approached [redacted]'s vehicle to inquire about why [redacted] had been pulled over. PO Perdomo allegedly yelled at [redacted] to, "Get the fuck away from the vehicle" [Allegation A]. When [redacted] did not respond, PO Amaury Soriano of the 46th Precinct, under the supervision of Sgt. Daniel Mufaddi of the 46th Precinct, allegedly approached [redacted], obtained his identification, and frisked him [Allegations B and C]. PO Soriano allegedly entered several of [redacted]'s pockets and removed several items [Allegation D]. While frisking [redacted], PO Soriano allegedly said, "Shut the fuck up," and "Give me your fucking ID" [Allegation E].
