Summary

On April 4th, 2009, at approximately 2:30pm, [redacted] was leaving [redacted] a NYCHA building. In the lobby, PO Jhovanny Isabel of PSA 5 stopped [redacted] and asked him if he lived in the building and to see his identification (Allegation A). [redacted] indicated that his sister lived in the building and provided his ID. PO Ysabel asked [redacted] to show the officers to his sister's apartment. PO Ysabel, his partner PO Brenda Torres of PSA 5 and [redacted] took the elevator to the [redacted] floor. When the elevator doors opened, [redacted] began yelling for his sister Debbie and stood a few inches from PO Ysabel. PO Ysabel grabbed [redacted] by the shirt collar (Allegation B). At this time, [redacted] [redacted]s sister, [redacted] and his girlfriend, Edith [redacted] exited [redacted]s apartment. [redacted] asked PO Ysabel for his shield number, but he did not respond (Allegation C). PO Ysabel let go of [redacted] and wrote him a summons for [redacted].
