Summary

On February 4, 2014, at approximately 3:00 p.m., inside of the 1 train station at 191st Street and Saint Nicholas Avenue in Manhattan, [redacted] swiped into the station with her friend, [redacted] using one Metro Card swipe. Upon entering through the turnstile, [redacted] alleged that PO Rene Mendez ordered her to "get the fuck out of the train station" along with other discourteous remarks throughout the incident using the word "fuck" (Allegation A). [redacted] acknowledged that she began to walk away from PO Mendez, toward the train, at which point PO Mendez allegedly grabbed her left arm and right shoulder, pulling her towards him, and [redacted] pushed PO Mendez off of her with her free arm. [redacted] alleged that PO Peri Maldonado approached at this point, and punched her in the left cheek, and afterwards [redacted] punched PO Maldonado back (Allegation B). Both [redacted] and PO Maldonado began pushing each other. [redacted] alleged that PO Mendez said "Oh, this bitch is giving you problems" (Allegation C). Both PO Mendez and PO Maldonado took [redacted] to the ground. [redacted] alleged that PO Maldonado grabbed her by the hair and smashed her head into the ground (Allegation D) while simultaneously saying "all black people are stupid" and that they get nowhere in life because "they do stupid shit like this" (Allegation E, Allegation F). [redacted] alleged that PO Mendez then pepper sprayed her (Allegation G). After [redacted] was pepper sprayed, PO Mendez and PO Maldonado placed her in handcuffs, and escorted her into an elevator leading up to the street level.
