Summary

On March 21, 2014, at approximately 4 a.m., [redacted] had just parked his vehicle in the driveway of his residence, located at [redacted] in Queens, when a marked patrol car pulled up behind him. [redacted] exited his vehicle, at which point, an uniformed officer, identified via investigation as PO Franklin Pierre-Louis from the 101st Precinct, ordered him to step back into it. PO Pierre-Louis was accompanied by an unidentified uniformed officer. PO Pierre-Louis [redacted] complied with the order and PO Pierre-Louis then allegedly stated to him, "Sit down and shut the fuck up" (Allegation A). Thereafter, [redacted] handed to PO Pierre-Louis a clear plastic holder containing his driver's license and registration, at which point PO Pierre-Louis allegedly stated, "I don't want that shit" (within Allegation A). [redacted] then directly handed to PO Pierre-Louis the documents without the holder. Later, PO Pierre-Louis returned the documents to [redacted] along with a summons, by allegedly throwing them through [redacted] car window (Allegation B). [redacted] claimed that his wife, [redacted] witnessed part of the incident and that two additional patrol cars later arrived at the scene. PO Pierre-Louis claimed that Sgt. Darryl Knight and PO Joseph Saddiqee, both from the 101st Precinct, and an unidentified officer arrived at the scene at some point during the incident.
