[redacted] alleged that April 25th, 2014 at 06:00 a.m., three individuals entered his apartment in the 40th Precinct, impersonated FBI agents, and stole $1,150. On April 27th, 2014, after viewing video footage of the robbery, [redacted] identified [redacted] his boss, as one of the robbers, and flagged down Sgt. Jonathan Villegas and PO Franky Almonte regarding the burglary. At approximately 11:10 p.m., [redacted] was walking to his store located at [redacted] in the Bronx when Sgt. Villegas and PO Almonte approached him in their marked RMP van. Sgt. Villegas asked [redacted] "What did you do today?" [redacted] stated that he did not do anything and was told to keep on walking. Upon arriving at his store, [redacted] called the police in order to make a complaint against [redacted] for allegedly stealing money from his store. Officers responded and took a report. At approximately 1:43 a.m. on April 28th, 2014, after [redacted] closed the store for the night, Sgt. Villegas and PO Almonte re-approached [redacted] on Guerlain Street, a few blocks from his store. [redacted] alleged that Sgt. Villegas said, "What did you do today? I don't give a fuck about it. I can't do anything about it." Sgt. Villegas later asked [redacted] if he was a "smart ass." (Allegation A). After obtaining [redacted]'s ID, Sgt. Villegas asked [redacted] if he was an "A-rab" and if he was a citizen of the United States (Allegation B). [redacted] walked away from the police van and back to his store, while the officers followed. [redacted] dialed 911 and stated that he was going to report the officers to IAB for harassment. At the store, while [redacted] remained on the phone, Sgt. Villegas stated, "You call IAB, I am going to have to lock you up."
