Summary

On June 12, 2014, at approximately 6:30 a.m., [redacted] was inside his apartment, located at [redacted] in Brooklyn, when he heard knocking on his door. [redacted] opened the door and faced at least two officers, identified via investigation as Det. William Schmidt and Sgt. Raymond Tomins from the Warrant Section. Det. Schmidt explained that the officers were searching for [redacted]. [redacted] resides inside the apartment with [redacted], and [redacted], [redacted] is the brother of [redacted]. Soon thereafter, Det. Schmidt and Sgt. Tomins entered the apartment and searched it (Allegations A and B). During the search, Det. Schmidt entered [redacted]'s bedroom and pointed his flashlight at her, at which point Det. Schmidt allegedly pressed the flashlight against her face, causing swelling there (Allegation C). At that point, [redacted] stood up from a couch and approached [redacted]'s bedroom. Det. Schmidt then allegedly pushed [redacted] back, causing him to fall against a nearby wall (within Allegation C). [redacted] allegedly sustained swelling to his head due to his fall. At some point, Det. Schmidt searched kitchen drawers (within Allegation B). At another point, Det. Schmidt allegedly threatened to arrest [redacted] (Allegation D), stated to him, "Shut the fuck up" (Allegation E), and again threatened to arrest him (within Allegation D).
