Summary

On October 18, 2014, at approximately 7:13 p.m., [redacted] was taking out the garbage at his girlfriend [redacted] apartment complex located at [redacted] in Staten Island. While in the 10th floor hallway, walking back to the apartment, [redacted] observed two plainclothes officers identified by the investigation as PO Omar Elsayed and PO Lee Maldonado of the 121st Precinct exit from a staircase door. [redacted] asked the officers, "What happened?" PO Elsayed then allegedly stated, "Hey buddy. Do you live here?" (Allegation A) [redacted] stated that he did and PO Elsayed allegedly requested to see his ID. [redacted] began to back-peddle and asked, "Why did I do something?" Both officers then allegedly asked him several more times for ID (within Allegation A and Allegation B) and [redacted] went to grab the door of apartment which belonged to [redacted] Both officers then sped walked up to the door and PO Elsayed allegedly stated, "Bro, let me see your ID." The conversation then continued in the hallway of the apartment. [redacted] stated that the door of the apartment was cracked and both officers pushed on the door while PO Elsayed placed his right foot in the door to prevent [redacted] from closing it (Allegations C, D, E and F). [redacted] pushed back on the door to try to close it. PO Elsayed allegedly stated, "Bro, are you fucking crazy?" (Allegation G) [redacted] then screamed [redacted] name and let go of the door. [redacted] stated that as he began to back away from the officers, PO Maldonado allegedly shoved [redacted] with his right forearm and stated, "Back-up."
