Summary

On January 10, 2015, at approximately 12:20 a.m., [redacted] and [redacted] entered the Morgan Avenue L subway station entrance located at the intersection of Bogart Street and Harrison Place in Brooklyn. [redacted] and [redacted] were high school classmates, [redacted] is [redacted]s girlfriend, and [redacted] is [redacted]s girlfriend. [redacted] and [redacted] were roommates at the time of the incident, and [redacted] and [redacted] were visiting from Philadelphia. [redacted] and [redacted] swiped their MetroCards to enter.
[redacted] and [redacted] did not have MetroCards and entered through the emergency exit gate, which was opened by one of the individuals who had already paid. The group was stopped by PO Jason Tejada and PO Jason Witthohn of Transit District 33. The officers said that they had seen [redacted] and [redacted] evade the fare and waited for warrant checks to be performed before issuing them summonses. During this time the civilians attempted to explain to the officers that they had mistakenly identified [redacted] as a perpetrator. PO Tejada allegedly used profanity when he ordered [redacted] and [redacted] to move away from the officers (Allegation A). PO Tejada also allegedly threatened to arrest [redacted] (Allegation B).
