On September 14, 2014, at approximately 12:15 a.m., [redacted] was driving eastbound on the Belt Parkway, from Brooklyn into Queens. He had one passenger in the vehicle, [redacted]. [redacted] was stopped by two officers, PO Thomas Kosak and PO Shawn Wandel. [redacted] was asked to exit the vehicle and a sobriety test was administered. [redacted] alleged that PO Kosak and PO Wandel spoke discourteously to him throughout the encounter, using the words, "fuck," "fucking bullshit," "I don't give a fuck about that," and "idiot" (Allegations A and B). While standing at the rear of the vehicle, PO Wandel grabbed [redacted] in order to restrain him (Allegation C).
