On March 1, 2015, at approximately 12:50 p.m. [redacted] was intoxicated at the St. Patrick's Day parade in Staten Island, at the intersection of [redacted] A large crowd had gathered at this intersection, as it was on the parade route. PO Jason Greenberg, who was then assigned to the 120th Precinct, and several other officers, including Captain Thomas Kamper of the 120th Precinct, PO Matthew Gueli, who was then assigned to the 120th Precinct, and PO Charles Galletta, who was then assigned to the Staten Island Task Force, were monitoring the parade route at this time and location.
PO Greenberg was blocking pedestrian traffic from entering a strip of businesses on the southwest corner of [redacted] [redacted] alleged that after calmly asking PO Greenberg if he could bypass him in order to purchase a bagel from one of the aforementioned businesses, PO Greenberg pushed [redacted] in the chest (Allegation A). [redacted] reported that he then pushed PO Greenberg in the chest-according to various reports, including the testimony of an independent witness, [redacted] (Board Review 02), [redacted] punched PO Greenberg in the face. [redacted] was identified as a witness by an entry in PO Gueli's memo book, and she did not indicate that she had a relationship with any of the parties involved in this incident. PO Greenberg was later transported to the hospital via ambulance for a reported laceration and bruising to the face (Board Review 03).
[redacted] alleged that after he pushed PO Greenberg, he was pushed from behind, over a metal barricade and onto the ground; [redacted] alleged that four to five officers then proceeded to kick and punch him in the ribs, on his back, his legs, and on both sides of his upper body (Allegation B). PO Greenberg testified that he punched [redacted] after he had gone to the ground, prior to [redacted] being secured in handcuffs (Allegation C).
