Summary

On March 16, 2015, at 11:30 p.m., [redacted] was standing on Barnes Avenue between East 214th and East 215th Street in the Bronx, speaking with an acquaintance named [redacted]. An unmarked black police car pulled up to [redacted] with three plainclothes officers inside, identified via the investigation as PO Michael Whelan, PO Bennett Shelley, and Sgt. Thomas Casey all of the 47th Precinct. PO Whelan asked [redacted] for his name, and after he allegedly provided it, the officers exited their vehicle and walked up to [redacted] (Allegation A). [redacted] recognized PO Shelley from a previous incident in which PO Shelley arrested [redacted] for possession of a loaded firearm (See Board Review #8). PO Shelly then stopped and frisked [redacted] (Allegation B). PO Shelley also allegedly searched [redacted] reaching into his pants pockets and removing his car keys (Allegation C). [redacted] asked PO Shelley why the officers were harassing him, and PO Shelley allegedly responded, "Shut the fuck up and keep your hands in the air," (Allegation D). PO Shelley took [redacted]'s car keys, unlocked his vehicle, and then allegedly searched the trunk while an unidentified officer allegedly searched the front passenger seat (Allegations E and F). The officers then left without arresting [redacted] or issuing either of them a summons.
On April 1, 2015, at 1:37 a.m., [redacted] parked his vehicle in a no standing zone in front of 4644 White Plains Road in the Bronx. His friend, [redacted] exited his vehicle and walked across the street to the 50/50 Convenience Store. [redacted] exited his vehicle thirty seconds later and started walking across the street to the store. An unmarked black RMP with two plainclothes officers inside identified via investigation as PO Bennett Shelley and Lt.
