Summary

On April 2, 2015, at approximately 1 p.m., PO Mark Desimone, then assigned to the Counterterrorism Division, drove his personal vehicle during his lunch break to a BP gas station located at 2978 Cropsey Avenue in Brooklyn. PO Desimone was not in uniform. The station is full-service but PO Desimone attempted to pump his own gas, and he eventually became engaged in a dispute with the station attendant, [redacted]. PO Desimone used the word "fuck" when he told [redacted] to get away from him (Allegation A). PO Desimone also pushed [redacted] in the chest (Allegation B). PO Desimone eventually displayed his shield and identification, identified himself as a police officer, and threatened to arrest [redacted] (Allegation C).
