Summary

At approximately 11:33 am on April 23, 2015, [redacted] was engaged in a dispute with his employer over a sum of money [redacted] had collected for work performed. [redacted] was seated in the driver's seat of his vehicle. PO Lomax Augustin approached the men and inquired about the nature of their disagreement. When [redacted]s employer accused [redacted] of theft, PO Augustin requested [redacted]s identification. He checked [redacted]s license, determined it had been suspended, and arrested him for [redacted]. PO Augustin transported [redacted] to the 71st Precinct stationhouse and lodged him in a cell.
Approximately forty-five minutes later PO Augustin informed [redacted] that his commanding officer, Lt. William Harris, had instructed him to charge [redacted] with [redacted]. [redacted] did not then know Lt. Harris' name. At approximately the same time, [redacted]s wife, [redacted] arrived at the stationhouse. She saw Lt. Harris, behind the desk, look at [redacted] through a Plexiglas window and allegedly refer to [redacted] as an "asshole" and a "piece of shit" multiple times (Allegation A). Meanwhile, inside the cell area, [redacted] began to feel pain in his chest. [redacted] told PO Augustin about the pain and informed him that he had a pacemaker for a cardiac condition. PO Augustin alerted Sgt. Comas, the desk officer, who called EMS. [redacted] was allowed to speak with [redacted] briefly in the cell area before returning to the desk area.
Shortly thereafter, EMT Paramedics [redacted] and [redacted] arrived at the stationhouse. They treated [redacted] in the cell area and determined that his condition was stable. They placed [redacted] in a wheelchair and wheeled him out of the cell area in order to remove him to [redacted]. PO Augustin walked with them. As they passed by the desk, Lt. Harris was walking in the opposite direction. [redacted] requested Lt. Harris' name and shield number, and Lt. Harris allegedly said, "You're a smart guy.
