On May 5, 2015, at approximately 7:35pm, [redacted] was walking toward his residence, located at [redacted] in Manhattan. After [redacted] paused to answer his mobile telephone near a marked police van, PO Jose Rodriguez of Police Service Area 4 allegedly asked him, "What are you doing here? Why did you stop?" (Allegation A). [redacted] attempted to record the incident on his telephone, the continued walking toward his residence. Once he had nearly reached his residence, PO Rodriguez allegedly shouted after him, "If you come near me again, I'll arrest you for harassment!" (Allegation B).
