Summary

At 7:15 p.m. on April 13, 2015, [redacted] was riding an ATV with a group of numerous other men on ATVs, motorcycles, and dirt bikes in the confines of the 113th Precinct. A marked NYPD van occupied by officers identified as PO Richard Ernyey and PO Jason Figari began following [redacted] and allegedly attempted to pull him over. At the intersection of 195th Street and 109th Avenue in Queens, [redacted] alleged that PO Ernyey struck his ATV with his RMP (Allegation A) causing him to be thrown from the ATV. [redacted] began running towards [redacted]s house at [redacted] with the officers pursuing him. [redacted] alleged that PO Ernyey ordered [redacted] to stop or he would "shoot [him] in the back" (Allegation B). Upon stopping in [redacted]s driveway, [redacted] turned around to give himself up to the police.
