Summary

At approximately 11:30 a.m. on May 16, 2015, [redacted] went to the Duane Reade drugstore located at 386 Fulton Street, in Brooklyn, in order to return a pack of cigarettes. There, she got into a dispute with two store employees, [redacted] and [redacted] [redacted] and [redacted] went into the store's office, while [redacted] waited outside for them. When [redacted] and [redacted] did not come out, [redacted] began shouting at them through the door. [redacted] then called 911 to report [redacted]s behavior.
Two uniformed officers, Det. Richard Baez and PO Anthony Caputo of the 84th Precinct, arrived at the store to find out what was happening. They asked [redacted] to leave the store while they spoke with [redacted] and [redacted] [redacted] gave the officers a photocopy of the store's return policy, which forbids refunds for cigarettes. Det. Baez and PO Caputo went back outside to explain the situation to [redacted] The store employees remained inside of the drugstore at that time. PO Caputo gave her the copy of the store's policy. [redacted] complained, stating that she wanted her money back. Det. Baez replied, "If you don't leave, I'm going to lock your fucking ass up" (Allegation A).
[redacted] threw the photocopy to the ground and started to walk away. Det. Baez and PO Caputo then stopped her and placed her in handcuffs. [redacted] was then transported to the 84th Precinct stationhouse. After she was taken into custody, officers searched her person, finding a can of pepper spray. PO Caputo issued [redacted] summonses for [redacted]. She was then released from custody at the stationhouse. Read report for details.
