On May 18, 2015, at approximately 8:37 p.m., [redacted] called 911 after he was allegedly assaulted by a security guard at the Family Dollar store at 2105 Clinton Avenue in the Bronx. PO Michael Gotovich and PO Jason Treglia responded. When [redacted] said that he wanted the officers to arrest the security guard, PO Gotovich allegedly threatened to arrest [redacted] (allegation A). After [redacted] asked that PO Gotovich make a report, PO Gotovich allegedly responded, "You are a troublemaker, motherfucker. Get the fuck out of here" (allegation B). [redacted] then asked PO Gotovich and PO Treglia for their shield numbers, but neither officer responded (allegations C and D). PO Treglia removed his baton, held it up, and told [redacted] "Get the fuck out of here, fucking Spanish" (allegations E and F). [redacted] wrote down the license plate numbers for PO Gotovich's RMP and the ambulance that had arrived. According to [redacted] PO Gotovich threatened to hit or arrest [redacted] if he did not get into the ambulance (allegations A and G). [redacted] was removed from the scene by ambulance [redacted]. He was not summonsed or arrested.
On May 21, 2015, at approximately 10:28 p.m., [redacted] went to the 48th Precinct stationhouse to file a report against the security guard from Family Dollar. [redacted] spoke with PO Treglia, who was sitting behind a desk. PO Treglia refused to make a report and told [redacted] to get the fuck out of the stationhouse before he got arrested for trespassing (allegations H and I).
