Summary

In the early morning of June 29, 2015, [redacted] was asleep in her bedroom, located at [redacted] in Brooklyn, along with her boyfriend [redacted] and their newborn child. Also present in the apartment were guests of [redacted] who were spending the night, [redacted] and their child. At approximately 12:20 am, [redacted] were awoken by sounds outside their closed bedroom, which prompted [redacted] to get up and open the bedroom door. When he did so, a plainclothes officer, PO Michael Ardolino, entered the bedroom, and instructed [redacted] to exit the apartment and go into the hallway outside, where another plainclothes officer, Sgt. Robert Martinez, was standing with [redacted] (Allegation A). Also present in the hallway was [redacted] friend. PO Ardolino began demanding that [redacted] tell him where the gun was located. As PO Ardolino visually inspected the bedroom, [redacted] told him that there was no gun in the apartment. PO Ardolino allegedly tried to open a non-functioning safe inside the bedroom, and then retreated into the living room, where he searched beneath a dresser, a mattress, and a bed, and ultimately attempted to open a suitcase he found under the bed (Allegation B). PO Ardolino continued to repeatedly ask [redacted] about a gun, and told her that he would notify ACS if she did not tell him where it was (Allegation C). As PO Ardolino searched inside the apartment, Sgt. Martinez was in the hallway with [redacted] While in the hallway, Sgt. Martinez frisked [redacted] (Allegation D). Additionally, at one point, Sgt. Martinez also entered the apartment briefly (Allegation E). At some point, while speaking with [redacted] in the hallway, Sgt. Martinez told her to "shut the fuck up." (Allegation F).
