On August 6, 2015, at approximately 11:35 p.m., [redacted] Is vehicle was pulled over by an unmarked vehicle on the corner of Roosevelt Avenue, Queens Boulevard and 48th Street. PO Dominic Ruggiero, PO James Campbell and Sgt. Daniel Marussich, all of the 108th Precinct, approached [redacted] Is vehicle. Sgt. Marussich allegedly reached his hand through the driver's side open window, opened the door, grabbed [redacted] by the arm, and pulled him from the vehicle (Allegation A). Once [redacted] exited his vehicle, Sgt. Marussich escorted him to the back of his vehicle and allegedly slammed his right hand on the trunk (Allegation A continued). Sgt. Marussich frisked [redacted] Is sweatpants (Allegation B ). When [redacted] requested the badge numbers of all three officers, none of them provided this information (Allegations C, D, and E). While [redacted] remained near the trunk of his vehicle, PO Ruggiero allegedly entered the driver's seat of his vehicle, while PO Campbell allegedly entered the passenger side. The officers allegedly searched underneath the seats, in the glove box and behind the radio (Allegations F and G). [redacted] observed PO Ruggiero write him two summonses; one for a defective break light and one for a display of blue colored lights in the front of his vehicle. When PO Ruggiero gave [redacted] the summonses, he reminded him that they had not provided him with their badge numbers.
