Summary

On September 16, 2015, at approximately 5:45 A.M., Cpt. Christopher Henning, Sgt. Michael Miller, and additional officers, all from Bronx Narcotics, executed a search warrant at [redacted] in the Bronx (Allegation A). [redacted] and [redacted] were handcuffed and detained as the apartment was searched. During that time, Sgt. Miller allegedly told [redacted] that she and [redacted] were "fucking drug dealers" approximately three times and when [redacted] told Sgt. Miller not to speak to [redacted] that way, Sgt. Miller allegedly replied, "What the fuck you gonna do? What the fuck you gonna do?" (Allegation B). Sgt. Miller mentioned being inside the apartment before and when [redacted] accused him of lying, Sgt. Miller allegedly said, "Oh, look at your ass. Look at your ass. Just shut the fuck up" (within Allegation B). [redacted] asked Cpt. Henning for a copy of the search warrant and Cpt. Henning allegedly replied, "I ain't gotta leave shit. You watch too much fucking TV. That's your fucking problem. I ain't gotta leave shit" (Allegation C), although he then provided the requested document. After the search of the apartment yielded negative results, [redacted] and [redacted] were released.
This case was delayed due to Bronx Narcotics' initial refusal to provide the NYPD documents relevant to this case until the conclusion of their investigation. Read report for details.
