On February 14, 2016, at approximately 3:00 a.m. [redacted] was sitting in the driver seat of [redacted]s idling vehicle in a No Parking Anytime zone in front of [redacted] in Manhattan. [redacted] and [redacted] were upstairs in [redacted]s apartment on [redacted] dropping items off. Lt. Thomas Oneill and PO Vincent Ciccolella of the 32nd Precinct stopped [redacted]s vehicle (Allegation A). [redacted] allegedly provided Lt. Oneill with a New York City ID and said the car was [redacted]s. Lt. Oneill asked [redacted] to exit the vehicle and frisked him (Allegation B). Lt. Oneill entered the vehicle through the driver side door and checked to see the ignition was undamaged. Lt. Oneill then removed the key from the ignition and searched underneath the driver seat for weapons (Allegation C). [redacted] returned from the upstairs apartment and asked Lt. Oneill why officers were searching the vehicle. Lt. Oneill allegedly spoke discourteously to [redacted] and refused to provide his name and shield number (Allegations D and E). [redacted] retrieved the vehicle registration from the driver side compartment and presented it to Lt. Oneill. Officers ran warrant checks with negative results and confirmed the vehicle was registered to [redacted] (BR 01; BR 27). Lt. Oneill returned the vehicle registration and keys to [redacted] but allegedly did not return the provided identification (Allegation F). No summonses were issued [redacted] (BR 02).
