On February 20, 2016, at approximately 1:30 p.m. [redacted] was riding his bicycle at the intersection of Fulton Street and Hanson Place in Brooklyn. It is undisputed that [redacted] bicycle almost collided with a police vehicle occupied by PO Collin Henry, although [redacted] faulted PO Henry with this near collision while PO Henry believed it was a result of [redacted] cycling through a red light. [redacted] stopped his bicycle after the near collision, and exchanged numerous "hand gestures" with PO Henry, who appeared to turn on his emergency lights, make a U-turn, and then turn off his emergency lights. Believing the situation was over, [redacted] resumed riding his bicycle along approximately six blocks on Fulton Street. As he rode his bicycle, [redacted] noticed that he was being pursued by PO Henry's vehicle, and [redacted] stopped and dismounted from his bicycle. PO Henry exited from his vehicle and approached [redacted] alleged PO Henry stated "You fucking asshole. You heard me tell you to stop" (Allegation A). [redacted] denied this, and accused PO Henry of having almost hit him with his vehicle. PO Henry allegedly stated "give me your fucking license" and [redacted] replied that he was not driving a vehicle (Allegation A). PO Henry then requested [redacted] provide identification, which [redacted] did. PO Henry returned to his vehicle, and allegedly told [redacted] he would "lock his dumb ass up" if he had a warrant (Allegation B). PO Henry remained at his vehicle for approximately 5 minutes, after which he returned to [redacted] and issued him a summons for passing through a red light.
