On February 20, 2016, at approximately 5:00 p.m. Sgt. Sinatra and three other members of service from Queens North Narcotics—Detective Victor Rosario, PO Julio Meyreles, and PO Eric Moy—were driving in an unmarked vehicle when they observed [redacted] walking on the sidewalk, allegedly smoking a marijuana cigarette. This was undisputedly the only reason to approach [redacted].
PO Moy stopped the vehicle approximately two car lengths behind [redacted] who continued to walk on the sidewalk. Sgt. Sinatra and PO Meyreles exited the vehicle and, within a few seconds, [redacted] looked behind him and began to run. Sgt. Sinatra and PO Meyreles gave chase on foot, while PO Moy and Det. Rosario reversed in their vehicle in the direction of [redacted]'s flight. Video footage captures this portion of the incident.
As he drove in reverse, PO Moy passed the fleeing [redacted] and stopped the vehicle in the street. Det. Rosario exited the vehicle and stepped in [redacted]'s path on the sidewalk, causing the two to collide and [redacted] to stop. Sgt. Sinatra reached [redacted] a couple of seconds after he collided with Det. Rosario. Video footage indicates that within two seconds of Sgt. Sinatra reaching [redacted], Sgt. Sinatra appears to punch him in the face (Allegation A).
The CCRB found evidence to suggest that Sgt. Sinatra provided a false official statement regarding this incident (Allegation B), which was referred to IAB as a spin-off case on April 13, 2016 (Board Review 02).
