On April 16, 2016, at approximately 4:30 a.m., [redacted] was pulled over by PO Vito Poliseno and PO Drewe Cupid of the 67th Precinct on Snyder Avenue and East 42nd Street in Brooklyn. PO Poliseno and PO Cupid approached [redacted]s car with their guns pointed at him, and PO Poliseno allegedly punched [redacted]s car window (Allegations A, B, and C). Upon exiting his car, [redacted] was allegedly frisked and searched by PO Poliseno (Allegations D and E). PO Poliseno then pushed [redacted] and told him, "Don't fucking spit in my face" (Allegations F and G). PO Poliseno asked [redacted] "You want to get in cuffs right now? Is that what you fucking want?.. Fucking relax" (within Allegation G, Allegation H). Additional officers responded to administer a portable breathalyzer test, which confirmed that [redacted] was intoxicated. After placing [redacted] under arrest for [redacted], PO Poliseno allegedly searched [redacted]s car (Allegation I) (Board Review 02).
[redacted]s neighbor, [redacted] filmed a portion of the incident. She provided the video to [redacted] who then forwarded to the CCRB. The footage shows PO Poliseno pushing [redacted], making discourteous statements to him, and threatening to arrest him. It also shows PO Poliseno entering [redacted]s car.
