Summary

On August 20, 2016, at approximately 9:30 A.M., in the vicinity of 175th Street and Jamaica Avenue in Queens, [redacted] was walking with her boyfriend, [redacted] and her sister, [redacted]. The three had recently left a methodone clinic located at [redacted] on [redacted], where each of them had received a prescription methodone bottle that was labeled with his/her name and address. [redacted] was carrying a purse, which she used to carry both her and [redacted]'s methodone bottles, because [redacted] had no purse.
PO Brian Volpi of Narcotics Borough Queens South allegedly questioned, stopped, and searched [redacted]'s person and purse (Allegation A, Allegation B, Allegation C). A second officer allegedly questioned, stopped and searched [redacted] (Allegation D, Allegation E, Allegation F), while a third officer allegedly questioned, stopped and searched [redacted] (Allegation G, Allegation H, Allegation I) PO Volpi observed two bottles of methodone in [redacted]'s purse. [redacted] and [redacted] allegedly informed the officers that [redacted] was temporarily carrying [redacted]'s bottle because [redacted] did not have pockets or a purse, and [redacted] and [redacted] each provided identification that matched the prescription labels on the methodone bottles in question.
PO Volpi requested that his supervisor, Sgt. Mark Sinatra, respond to the location, and Sgt. Sinatra arrived on scene shortly thereafter in a black Toyota. It is alleged that two to three other officers were present with Sgt. Sinatra. Sgt. Sinatra allegedly searched [redacted]'s purse (Allegation J) and recovered both [redacted]'s bottle of methodone, as well as a metal thimble which allegedly contained heroin residue.
