Summary

On August 27, 2016, at approximately 12:25 a.m. [redacted] was standing on the northwest corner of Throop Avenue and Pulaski Street in Brooklyn waiting for his girlfriend, [redacted]. Police Officer David Mercado, Police Officer Gerard Cash and Police Officer Salvatore Melore of Patrol Borough Brooklyn North Specialized Unit approached the northwest corner of the intersection in an unmarked RMP. PO Cash parked the RMP and PO Mercado exited the RMP and stopped [redacted] (Allegations A, B and C). PO Mercado allegedly punched [redacted] (Allegation D). PO Mercado held [redacted] against a crosswalk pole, and allegedly held his forearm against [redacted]'s neck, causing his breathing to be restricted (Allegations E and F). PO Melore and PO Cash exited the RMP then approached. PO Mercado frisked [redacted] (Allegation G). PO Cash allegedly frisked and searched [redacted] (Allegations H and I). After PO Mercado released him, [redacted] asked all three officers for their name and shield numbers, and they allegedly did not respond (Allegations J, K and L). [redacted] held the door of the RMP, and in response PO Mercado and PO Cash pushed [redacted] back towards the sidewalk (Allegations M and N). [redacted] alleged that during this push, PO Mercado choked [redacted] and restricted his breathing (Allegations O and P). Officers reentered the RMP and drove away. Approximately five minutes later, officers returned to the intersection to speak with [redacted]'s mother, [redacted], and provided their names and shield numbers to her.
