Summary

At approximately 9 am on September 9, 2016, [redacted] was driving on Boston Road near Waring Avenue, in the Bronx. When he changed lanes to circumvent an unrelated traffic stop, he was pulled over by PO Pierre (Allegation A). After pulling over, [redacted] told PO Pierre that he did not commit a violation, and did not provide his driver's license for one or two minutes, during which time PO Pierre said, "Give me your fucking license," and threatened to "drag [redacted] out of the fucking car" and "beat [his] ass" (Allegations B and C). [redacted] subsequently gave PO Pierre his license, and PO Pierre returned to his RMP to write [redacted] a summons for making an unsafe lane change. When PO Pierre returned to [redacted] s vehicle to give him the summons, an exchange ensued during which PO Pierre said to [redacted] "You know what happens with cops in your country?...You know what they would have done there, right?" (Allegation D). PO Pierre presented the summons to [redacted] and gave him permission to leave the scene.
