Summary

On November 19, 2016, [redacted] stopped at a friend's residence and left his white Chevrolet Venture van double-parked on Stanley Avenue in Brooklyn. [redacted] left his wife, [redacted] in the passenger's seat. [redacted] remained away from the vehicle for about 20 minutes.
[redacted] returned to his vehicle at about 12:30 a.m. and drove away. PO Matthew Demaio and PO Ramil Casimir, of the 75th Precinct Anti-Crime Team, initiated a stop of [redacted] vehicle in the vicinity of [redacted] in Brooklyn. [redacted] did not immediately stop; rather, he continued driving for about 300 feet before pulling into a NYCHA parking lot.
When the officers approached [redacted] vehicle, they observed that at least one knife was in plain view. PO Casimir alerted PO Demaio of the knife, and both [redacted] and [redacted] were ordered to exit the vehicle. PO Demaio then frisked and searched [redacted] (Allegations A and B).
At some point following the search of [redacted] person, both PO Demaio and PO Casimir searched [redacted] vehicle (Allegations C and D). During the search, the officers discovered a machete. At some point, an officer discovered heroin under [redacted] vehicle and alleged that it belonged to [redacted]. The officers eventually parked [redacted] vehicle and allowed [redacted] who was not licensed to drive, to leave the scene.
PO Demaio and PO Casimir transported [redacted] to the 75th Precinct stationhouse. PO Demaio escorted [redacted] to a cell and removed only the right handcuff from [redacted]. PO Demaio then reportedly accused [redacted] of "eyeballing" him and then punched [redacted] in his face (Allegation E). PO Demaio allegedly accused [redacted] of attempting to strike him and then took [redacted] down to the floor (Allegation F). Approximately four more officers entered the cell area, and those officers allegedly kicked, punched, kneed, and elbowed [redacted] on his back, ribs, and neck before officers “mushed" [redacted] face into the ground (Allegation G).
