Summary

On September 2, 2016, [redacted] was standing in front of 729 Union Avenue in the Bronx, because he owed a an individual who resided in the building two dollars. The individual went inside of the building and told [redacted] that he would be back out to speak with him. [redacted] held two dollars in his hand and placed his hand through a gap of the gate in front of the building. [redacted] s hand accidentally hit the gate causing the two dollars to fall out of his hand and onto the ground on the other side of the building. [redacted] proceeded to walk away when a marked police vehicle stopped in front of him. Four police officers from the 40th Precinct exited the vehicle and approached [redacted]. Police Officer Malik McCloud of the 40th Precinct stopped [redacted] (Allegation A). After [redacted] could not provide photo identification, he was placed under arrest. A search of [redacted] resulted in the discovery of three bags of crack cocaine in his sweatpants pocket. [redacted] was transported to the 40th Precinct stationhouse. At the 40th Precinct stationhouse, Police Officer McCloud allegedly strip-searched [redacted] (Allegation B).
