At approximately 4:40 p.m. on January 27, 2017, [redacted] was arrested inside of the West 157th Street 1-Train Station for [redacted] (Board Review 11). He was transported to the Transit District 3 stationhouse, where he was held until the following morning.
At approximately 7:40 a.m. on January 28, 2017, [redacted] was sitting on the cell bench inside of the holding cell in the Transit District 3 stationhouse when Police Officers Ismael Camilo and Labeat Qosja of Transit District 3 went into [redacted] holding cell and told him that it was time to go to court. [redacted] was placed in handcuffs. Police Officers Jeffrey Phillip, Steven Waldron, and Peri Maldonado of Transit District 3 entered the cell. Police Officer Waldron told Police Officers Camilo and Qosja to leave the cell, and allegedly said, "You guys can step out of the cell, and I'm going to fuck him up" (Allegations A and B). Police Officers Camilo, Qosja, and Phillip walked out of the cell. Police Officers Waldron and Maldonado attempted to pick [redacted] up by his shoulders. They could not lift [redacted] and threw him back to the cell floor. He landed on his back. Police Officer Waldron allegedly said, "I'm going to kick your ass" (within Allegation A) and kicked [redacted] in the side one time (Allegation C). Police Officers Waldron and Maldonado lifted [redacted] and placed him onto the cell bench next to the outer cell wall. Police Officer Waldron allegedly placed his forearm across [redacted] chest, pressed [redacted] into the wall, and said, "I have a six-year-old daughter at home that acts better than you." With his free hand, Police Officer Waldron allegedly pressed his thumb forcefully into the upper cheekbone beneath [redacted] left eye (within Allegation C). [redacted] said, "I'm not gonna cry. Do what you have to do," and repeatedly said, "You're not gonna break me." Police Officer Waldron allegedly continued to press his thumb into [redacted] cheekbone for several minutes.
