Summary

On April 11, 2017, at approximately 11:49 a.m., [redacted] left the [redacted] in Manhattan and walked toward the subway entrance at East 15th Street and Union Square East. [redacted] spoke to his wife on the phone as he walked. PO Leonardo Nimo, who, at the time of the incident, was assigned to Patrol Borough Manhattan South Anti-Crime and was in plainclothes, walked past [redacted] in the opposite direction. PO Nimo heard [redacted] make insulting remarks, which he believed were directed at him, though [redacted] said they were part of his phone conversation. [redacted] stopped near a food cart, where PO Nimo approached him.
PO Nimo allegedly said, "What the fuck you say to me?" and made a variety of other discourteous statements (Allegation A). He identified himself as a police officer, told [redacted] he could arrest him, and challenged [redacted] to a fight (Allegations B and C).
[redacted] entered the Union Square subway station. PO Nimo pursued him and told him he would follow him all the way home. [redacted] then went to the Transit District 4 stationhouse, located in the Union Square station, to report PO Nimo's behavior. PO Nimo exited the subway station. [redacted] exited with several officers from Transit District 4. They found PO Nimo in Union Square Park and the entire group returned to the stationhouse, where [redacted] filed a complaint about PO Nimo. [redacted] requested PO Nimo's name and shield number, which PO Nimo allegedly refused to provide (Allegation D). [redacted] was not arrested or issued a summons. Read report for details.
