Summary

On April 11, 2017, [redacted] was pulled over on the corner of North Conduit Avenue and 136th Street in Queens by PO Maurice O'Connor and PO Mark Gaiardelli of the 113th Precinct. PO O'Connor stated that [redacted] was pulled over for using his cellphone. [redacted] opened the driver's side door because he believed his phone had fallen between the seat and the door. Upon opening the door, PO O'Connor allegedly stated, "You fucking asshole. Don't open the fucking door" (Allegation A). PO O'Connor then slammed the car door shut and returned to the police vehicle with the license. PO Gairdelli and a third unidentified, uniformed officer in a white shirt approached [redacted] vehicle. [redacted] told the white shirt officer that he needs to "talk to [his] officer." The white shirt officer replied, "I don't give a fuck." (Allegation B) and walked back to the police vehicle with PO Gaiardelli.
