Summary

On March 15, 2017, at approximately 1:30 p.m., [redacted] responded to a call for a tow truck in the vicinity of Morris Avenue and East 171st Street in the Bronx. He double-parked on Morris Avenue, a two way street with one lane in each direction, as he conversed with his customer. Seconds later, PO Jose Gonzalez and PO Abdul Jabbar, of the 44th Precinct, approached [redacted] s tow truck, and PO Gonzalez requested [redacted] s documents. Following a brief discussion with [redacted] PO Gonzalez allegedly told [redacted] "Watch your mouth, boy" or "Sit tight and watch your mouth, boy" (Allegation A). The officers returned to their vehicle, and PO Gonzalez drove away with [redacted] s documents (Allegation B). [redacted] followed them in his truck, and the officers stopped about a block later.
