Summary

On June 29, 2017 at approximately 4:10AM, [redacted], an employee of [redacted], located at [redacted] in Staten Island, was approached by [redacted] who asked [redacted] for a loose cigarette. [redacted] refused [redacted]'s request. [redacted] threw milk crates at the door of the deli and slashed the awning of the deli. [redacted] called 911. Police Officers Robert Paholek and Robert Bellantonio, both of the 120th Precinct, arrived to the location. PO Paholek and PO Bellantonio issued [redacted] multiple commands to drop the knife but [redacted] did not comply. PO Paholek pointed a Taser at [redacted] and PO Bellantonio pointed his gun at him (Allegation A). [redacted] took a step toward the officers with the knife in his hand and PO Paholek deployed his Taser against [redacted] (Allegation B). [redacted] dropped the knife in response. PO Paholek took [redacted] to the ground. While on the ground, [redacted] refused to provide his hands when asked. PO Bellantonio struck [redacted] multiple times with an asp (Allegation C). Police Officers Melissa Natal and Martin Abraham, also of the 120th Precinct, responded to the scene and assisted in handcuffing [redacted]. [redacted] was arrested as a result of this incident.
