Summary

At approximately 1:00 p.m. on July 15, 2017, [redacted] received a telephone call while he was alone at his house, which is located on [redacted] in the Bronx. He did not pick up the call because the phone number was private and he usually does not answer calls from private numbers. A voicemail message was left and when [redacted] played it, he heard an officer, who identified himself as Detective Noel Mendez from the 24th Precinct Detective Squad, address the message to [redacted] (Board Review 01). Detective Mendez provided a phone number on the voicemail message and asked [redacted] to return the call. When [redacted] called the phone number, he spoke to an individual who then transferred the call to Detective Mendez. [redacted] and Detective Mendez spoke to one another in Spanish. Detective Mendez informed [redacted] about a criminal complaint (Board Review 11) that had been filed against him and he instructed [redacted] to not contact the complainants again. [redacted] told Detective Mendez that Detective Mendez was "taking it personally." Detective Mendez allegedly told [redacted] "Well, you're going to be arrested, pendejo" (Allegations A and B) (Pendejo is a common Spanish insult which is translated by the Oxford Spanish Dictionary as "dumb" [Board Review 02]). [redacted] told Detective Mendez, "If you have an arrest warrant for me right now, come and arrest me. If you don't have an arrest warrant, then fuck off." [redacted] disconnected the call with Detective Mendez. No summonses were issued and no arrests were made, however, an I-Card with probable cause to arrest for aggravated harassment was subsequently issued for [redacted] by Detective Mendez (Board Review 05).
