Summary

At approximately 4:35 a.m. on July 30, 2017, [redacted] was with several friends at a restaurant located at 3151 Broadway in Manhattan. Among this group were [redacted] and a male who identified himself only as [redacted]. This group was accosted by another group that included [redacted] and [redacted]. A fight broke out between the two groups. Afterwards, the two groups fled into a nearby NYCHA development. They were pursued on foot by several officers from PSA 6, who caught up to them in front of [redacted]. [redacted] and [redacted] were all arrested for participating in the fight. These three individuals were arrested without incident.
[redacted] walked up to the officer who was placing [redacted] in handcuffs, PO Carlos Pimentel, and began to record [redacted]'s arrest. PO Pimentel told [redacted] to step back. He then turned to [redacted] and placed her in handcuffs (Allegation A). [redacted] was taken into custody along with [redacted] and [redacted]. [redacted]'s friend [redacted] allegedly tried to approach [redacted] after she was handcuffed. PO Pimentel allegedly told [redacted] that he would be arrested if he did not step back (Allegation B). Neither [redacted] nor any of the other civilians were arrested.
The four prisoners were transported to the PSA 6 stationhouse. From there, PO Pimentel's supervisor, Sgt. Elvis Badia, decided to void [redacted]'s and [redacted]'s arrests. Both women were released from custody at the stationhouse. [redacted] and [redacted] were both kept in custody. They were charged with [redacted].
[redacted] provided two cell phone videos of the incident that were recorded by [redacted] and another one of her friends, [redacted].
