Summary

On August 6, 2017, at approximately 2:20 am, [redacted] received a text message in which [redacted] who had noticed that someone was following him after he purchased marijuana near King's Plaza Shopping Center in Brooklyn. [redacted] rode his bicycle and met [redacted] in the vicinity of 1733 East 36th Street in Brooklyn, where they were stopped by Lt. Vito Ardito, PO Ardit Ymeri, PO Justin Barberi, and PO Jonathan Bourne, all of the 63nd Precinct (Allegation A and Allegation B). Lt. Ardito and PO Ymeri reportedly took [redacted] to the ground (Allegation C and Allegation D), while [redacted] fled, pursued by PO Bourne and PO Barberi. An unidentified officer searched [redacted]'s backpack and marijuana was recovered (Allegation E) and [redacted] was placed under arrest. [redacted] was also placed under arrest following the discovery of [redacted]'s marijuana (Allegation F). Lt. Ardito allegedly told [redacted] to, "Shut the hell up" (Allegation G), called him a "loser" and a disappointment to his family, and said that if [redacted] continued to protest his arrest, he would be taken to Central Booking, (Allegation H) where he would be raped (Allegation G, continued). PO Bourne allegedly accused [redacted] of wanting to be an "Asian Pablo Escobar" (Allegation I). [redacted] and [redacted] were transported to the 63rd Precinct Stationhouse. After interviewing [redacted], Lt. Ardito released both he and [redacted].
