Summary

On August 5, 2017, at approximately 9:00 p.m., Det. Peter McCarthy and Det. Paul Marconi of the Brooklyn South Gang Unit drove an unmarked police vehicle – a gray Dodge Charger – southbound on East 108th Street in Brooklyn. [redacted] drove his vehicle closely behind the unmarked police vehicle and made several traffic violations. [redacted] drove around the police vehicle and positioned himself directly in front of it. [redacted] continued to drive and made a right turn onto Farragut Road. Det. McCarthy turned on his turret lights and stopped [redacted]'s vehicle. Det. McCarthy positioned the police vehicle adjacent to [redacted]'s vehicle. Det. Marconi spoke to [redacted] through the front passenger's side window and warned and admonished him.
As Det. McCarthy drove off from the location, [redacted] followed behind and continued to drive closely behind the police vehicle. On the corner of Farragut Road and East 103rd Street, Det. McCarthy reactivated the turret lights and stopped [redacted]'s vehicle. Det. McCarthy exited the police vehicle, approached [redacted]'s driver side window and told [redacted] "I gave you a warning back there to stay the fuck away from my car" (Allegation A). After refusing to provide his identification several times, [redacted] was ordered to exit his vehicle and Det. McCarthy and Det. Marconi placed him in handcuffs. An unidentified officer, either Det. McCarthy or Det. Marconi, punched [redacted] on the right side of his ribs causing him pain to his lower back area (Allegation B). [redacted] was placed into the police vehicle. Det. Marconi entered into [redacted]'s vehicle, searched the glove compartment, and then moved it to a legal parking spot (Allegation C). [redacted] was then transported to the 69th Precinct stationhouse.
While en route to the stationhouse, Det. McCarthy told [redacted] "I don't give a fuck if you sue me or press charges. I'm about to be retired" (Allegation D). [redacted] was released on summonses [redacted] (BR 01 - 03).
