Summary

On September 16, 2017, at approximately 10:15 p.m., [redacted] was driving in a vehicle with [redacted] and parked in the vicinity of East 172nd Street and Ward Avenue in the Bronx. [redacted] exited the vehicle first and began walking, on the street, towards his residence, at which point Det. Gregory Kennedy, PO Satinderpal Singh, and PO Tomor Berisha, all from the 43rd Precinct, drove by [redacted] Det. Kennedy then allegedly stated to [redacted], "What the fuck you looking at?" (Allegation A: Discourtesy, [redacted]), after which all three officers exited their vehicle and forcibly stopped [redacted] and attempted to handcuff him (Allegations B, C, and D: Stop, [redacted]). [redacted] then approached the officers, at which point Det. Kennedy allegedly stated, "Move the fuck back," and, "Shut the fuck up," multiple times to them (Allegations E and F: Discourtesy, [redacted]). Det. Kennedy then proceeded to push [redacted] back three times, and allegedly caused her to fall back and hit her head against a light pole (Allegation G: Force, [redacted]). Afterward, Det. Kennedy allegedly stated, "What the fuck I said?" (within Allegation E: Discourtesy, [redacted]). [redacted] approached [redacted] and punched her on the left side of her jaw (within Allegation G: Force, [redacted]). [redacted] was then placed in handcuffs. During this time, Det. Kennedy continued to speak discourteously to [redacted] (within Allegation F: Discourtesy, [redacted]). Afterward, Det. Kennedy allegedly approached [redacted] and hit her face with the bottom of his palm as she was attempting to record the incident, causing her phone to fall to the ground and crack (Allegation H: Force; Allegation I: Abuse of Authority, [redacted]).
