On August 20, 2018, at approximately 10:45 pm, [redacted] walked along Cornaga Avenue, in Queens. He saw his friend [redacted] trip on cracked concrete and fall face down [redacted] in Queens. [redacted] called 911 for an ambulance. Within minutes, PO Amanda Sperling and PO Matthew Regan, from the 101st Precinct responded to the location and [redacted] identified himself as the 911 caller. PO Regan walked over to [redacted] who at that point was laying on his back in and out of consciousness. PO Regan allegedly kicked [redacted] in the shoulder and stated, "Hey buddy. Hey buddy" (Allegation A: Force, [redacted]). PO Regan walked around [redacted] and allegedly stepped on [redacted] jacket (Allegation B: Discourtesy, [redacted]). [redacted] told PO Regan not to put his feet on [redacted] and PO Regan allegedly responded, "Shut the fuck up. It's only a jacket, asshole. Get the fuck over there" (Allegation C: Discourtesy, [redacted]). In response, [redacted] called PO Regan an asshole. PO Regan allegedly pushed [redacted]'s left arm and he sustained pain to his elbow (Allegation D: Force, [redacted]).
Approximately 10 minutes later, PO Jose Villalba and PO James Drummy, from the 101st Precinct, and an ambulance responded to the scene. [redacted] was taken to [redacted].
