On September 18, 2018, [redacted] and her friend [redacted] were sitting on a bench [redacted] in Queens. Police Officer Frank Ryan and Sergeant Philip Picciano (Sergeant Picciano has since been promoted to the rank of Lieutenant and is assigned to the 115th Precinct), both of PSA 9, drove up to [redacted] and exited their vehicle, and approached them. PO Ryan allegedly frisked [redacted] and took marijuana out of his front pants pocket (Allegation A and Allegation B: Abuse of Authority, complainant uncooperative). PO Ryan issued [redacted] a summons for marijuana. [redacted] told [redacted] to give her his cell phone while PO Ryan was in the process of issuing the summons to [redacted]. [redacted] took the phone from [redacted] and Sgt. Picciano allegedly said, "Give me the fucking phone," (Allegation C: Discourtesy, unsubstantiated) and took the phone away from her.
