On October 12, 2018, at approximately 8:00 pm, in front of [redacted] in the Bronx, Sergeant Kevin Grayson, Detective Wilfredo Benitez, and Police Officer Maximo Gomez, of the 44th Precinct, approached [redacted] for playing loud music from his car. Det. Benitez wanted to issue [redacted] a summons and [redacted] refused to provide his identification. Det. Benitez handcuffed [redacted] to take him to the 44th Precinct stationhouse and properly identify him. Det. Benitez ordered the seizure of [redacted] s vehicle and requested for PO Gomez to drive it to the 44th Precinct stationhouse (Allegation A – Abuse of Authority - [redacted]). Det. Benitez searched [redacted] s vehicle at the stationhouse (Allegation B – Abuse of Authority - [redacted]). Sgt. Grayson failed to obtain medical treatment for [redacted] as per his request, while transporting him to the stationhouse (Allegation C – Abuse of Authority - [redacted]).
