Summary

On November 9, 2018, at approximately 2:07 p.m., [redacted] was als [redacted] in Manhattan. [redacted] was using the computer to look for jobs. An unidentified male instructed [redacted] to leave the facility. [redacted] continued working on the computer and ignored the unidentified male. [redacted] called 911, as well as [redacted]. Several minutes later, PO Timothy Chin and PO Terrance Marsh of the 28th Precinct arrived at the location. One of the officers allegedly told [redacted] that he was going to be either arrested and taken to jail or taken to the hospital if he did not leave (Allegation A: Abuse of authority – Threat of arrest, [redacted]). [redacted] was placed into handcuffs and was escorted to the lobby where the officers sat [redacted] on the ground. PO Chin radioed for an ambulance to remove [redacted] to the hospital (Allegations B and C: Abuse – Forcible removal to hospital, [redacted]). [redacted] tried to stand up and PO Chin and PO Marsh pushed him by the shoulders back into a seated position (Allegation D and E: Force - pushed, [redacted]). PO Marsh then stepped on the chain of [redacted] Is handcuffs (Allegation F: Force - Other, [redacted]). Two FDNY emergency medical technicians, EMT [redacted] and EMT [redacted], arrived and placed [redacted] onto a stretcher and brought him outside.
