Summary

On October 28, 2018, at approximately 8:18pm, PO Brendan Oseback responded to a vehicle accident involving [redacted] in the vicinity of 875 Avenue of the Americas in Manhattan. [redacted] was with a friend, [redacted] and two women he had just met, [redacted]. PO Oseback asked [redacted] if he had consumed any alcohol (Allegation A: Abuse of Authority-[redacted]). PO Oseback then administered a breathalyzer test to [redacted] (Allegation B: Abuse of Authority-[redacted]). [redacted] was then placed under arrest for DWI. While in the police vehicle, PO Oseback allegedly apologized to [redacted] for "cockblocking" him (Allegation C: Abuse of Authority-[redacted]) then asked PO Oseback to make a phone call from his phone, which PO Oseback allegedly did (Allegation D: Abuse of Authority-[redacted]). While in the police vehicle, PO Nicolas Morris described [redacted] as "hot" while speaking to [redacted] (Allegation E: Abuse of Authority-[redacted]). [redacted] was later transported to [redacted] for chest pain. While he was being transported from the hospital to Central Bookings, PO Brett Meritzsaccente allegedly described [redacted] as "sexy," "hot," and "smoking" (Allegation F: Abuse of Authority-[redacted]). [redacted] believed that, while he was in custody, an unidentified officer accessed his phone and obtained the womens' [redacted] information (Allegation G: Abuse of Authority-[redacted]). He suspected this because PO Morris followed [redacted] on [redacted] and messaged [redacted] (Allegations H and I: Abuse of Authority-[redacted]).
