Summary

On February 18, 2019, [redacted] was standing outside of a store located at the intersection of West 121st Street and Adam Clayton Boulevard in Manhattan on a Facetime call. [redacted] hung up, entered the store and encountered PO Ian Abramowitz and PO Rusty Garcia of the 28th Precinct. PO Garcia asked [redacted] "What the fuck, are you recording our vehicle?" (Allegation A: Discourtesy - [redacted]). PO Abramowitz and PO Garcia grabbed [redacted] by the chest and pushed him out of the store (Allegations B and C: Force [redacted]). PO Garcia's BWC shows PO Abramowitz call [redacted] a "bitch" and a "pussy" (Allegation D: Offensive Language - [redacted]).
[redacted] went to the 28th Precinct stationhouse to file a complaint. PO Abramowitz approached [redacted] and stated, "Stand the fuck up, you're going to jail today" (Allegation E: Discourtesy - [redacted]). PO Abramowitz placed [redacted] in handcuffs, brought him to the desk, and searched him. [redacted] refused to go to the cells without being told why he was being arrested and PO Abramowitz grabbed [redacted] face and pushed him back toward the cells. (Allegation F: Force - [redacted]). While in the cells, [redacted] kicked the door cell door approximately 40 times. Sgt. Thomas Helly of the 28th Precinct told [redacted] that if he continued to kick the cell door that he would call an ambulance. [redacted] kicked the cell door 10 more times before being removed to St. Luke's Hospital by EMTs, where he was released after 10 minutes (Allegation G: Abuse of Authority [redacted]). Immediately upon being released, [redacted] returned to the 28th Precinct stationhouse and began recording. Sgt. Helly told [redacted] that if he recoded video in the stationhouse that he would arrest him (Allegation H: Abuse of Authority [redacted]). [redacted] then left the stationhouse.
