Summary

At approximately 5:00 p.m. on March 27, 2019, [redacted] was driving westbound on Church Avenue and made a left turn on Ocean Avenue in Brooklyn. Police Officer Leon Batson and Police Officer Kimberly Joseph both of the 70th Precinct, pulled [redacted] over for failure to yield to pedestrians. [redacted] refused to provide his license to Police Officer Batson and rolled up his driver side window. Police Officer Batson allegedly told [redacted] "I'm going to break your fucking window" (Allegations A and B: Abuse of Authority, Exonerated and Discourtesy, [redacted]). [redacted] stepped out of his vehicle. [redacted] was placed in handcuffs and placed in the patrol vehicle. Police Officer Batson allegedly told [redacted] to "shut the fuck up" (Allegation subsumed in Allegation B). Police Officer Batson detained [redacted] in his patrol car (Allegation C: Abuse of Authority, [redacted]). Police Officer Batson called EMS and Sergeant Christopher Viola to the scene to remove [redacted] to the hospital (Allegation D: Abuse of Authority, [redacted]).
